In Quebec (Attorney General) v. Kanyinda, 2026 SCC 7, decided on March 6, 2026, the Supreme Court of Canada ruled that excluding refugee claimants from Quebec’s subsidized daycare program is discrimination under the Canadian Charter of Rights and Freedoms.
What happened
Ms. Kanyinda, a refugee claimant living in Quebec with her children, was refused a place in subsidized (reduced-contribution) daycare because a Quebec regulation did not include refugee claimants among the parents who qualify.
What the Court decided
- The rule applies to all refugee claimants, but it hurts women more, because women are more likely to carry the main childcare responsibilities, and access to childcare is closely tied to their ability to work.
- That effect is discrimination based on sex under section 15 of the Charter, and Quebec did not justify it under section 1.
- Refugee claimant parents living in Quebec should be eligible for subsidized daycare.
What this means for you
The ruling deals with a Quebec program, so it does not directly change programs in Ontario. It confirms that refugee claimants are protected by the Charter’s equality rights, and that a rule can be discriminatory because of its effects, even when it looks neutral on paper.
